ORDER
This Writ Petition has been filed for a direction, directing the respondents 3 and 4 to produce Book No. 5 kept in their offices for the period from 01.01.2005 to 03.06.2013.
2. The petitioner's father died on 03.06.2013. When his father was in death bed, he informed to his family members that he had executed a Will and the same was kept in a sealed cover and deposited the same with the Sub Registrar. However, without furnishing other details, he died. Therefore, the petitioner believed that the testament should have been deposited either before the third respondent or before the fourth respondent in between 2005 to 2013. Now, the petitioner sought for direction, directing the respondents 3 and 4 to produce Book No. 5 kept in their offices for the period from 01.01.2005 to 03.06.2013. 2/4
3. Heard the learned counsel on either side and perused the materials placed before this Court.
4. On perusal of the counter filed by the third respondent and on submission made by the Additional Government Pleader and on verification of register in book No.5, it revealed that there was no entry made for deposit of any document. That apart, the petitioner himself filed this writ petition on mere suspicion of doubt that the petitioner's father had deposited the Will. Like wise, the fourth respondent also submitted that on verification of book No.5, there is no entry in respect of deposit of any document by the petitioner's father.
5. In view of the above, the direction sought for in this petition cannot be considered and the writ petition is liable to be dismissed. Accordingly, this Writ Petition stands dismissed. No costs. Internet : Yes/No 09.01.2025 NCC : Yes / No LS 3/4
