: Respondents PRAYER: Petition is filed under Section 482 of the Criminal Procedure Code praying to direct the respondent police to investigate the offences registered against Mr.P.Selvam, S/o Periyasamy, resident of Uppiliyapura, Thuraiyur Taluk, Trichy District in Crime No.178 of 2015 dted 18.06.2015 and file a final report before the appropriate Court and pass such further or other orders as this Court may deem fit and proper in the circumstances of the case.

ORDER

The petitioner has come forward with this petition under Section 482 of Code of Criminal Procedure, seeking a direction to the respondent police to investigate the offences registered against Mr.P.Selvam, S/o Periyasamy, resident of Uppiliyapura, Thuraiyur Taluk, Trichy District in Crime No.178 of 2015 dted 18.06.2015 and file a final report before the appropriate Court.

2. Heard the submissions made by the learned counsel appearing on either side.

3. The learned counsel for the petitioner would submit that on the basis of the complaint given by the petitioner, a case has been registered in Crime No.178 of 2015 on 18.06.2015 for the offences punishable under Sections 427, 294(b) IPC. However, the respondent has not shown any interest to investigate the matter and lay a final report. Hence, the petitioner has come up with the present petition for the relief as stated above.

4.Resisting the same, the learned Government Advocate (Crl.side) would submit that investigation is going on and hence, he prays for two months time to file a final report.

5. Considering the submissions made on both sides and also considering the fact that on the basis of the complaint given by the petitioner, after due enquiry, the case in Crime No.178 of 2015 has been registered as early as on 18.06.2015, this Court is inclined to grant two months time to the second respondent to complete the investigation and file a final report.

6. Accordingly, the second respondent is directed to complete the investigation in Crime No.178 of 2015 and file a final report, within a period of two months from the date of receipt of copy of this order.

7. The Criminal Original Petition is disposed of with the above direction.
