Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 406, 465, 467, 468, 471, 420, and 120(B) I.P.C., in Crime No.8 of 2018, seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Government Advocate(Crl.Side) for the respondent. 3.This Court by order dated 11.04.2018 granted interim anticipatory bail to the petitioner and directed him to appear before the respondent police daily and co-operate with the investigation. The petitioner had complied with the condition imposed by this Court regularly. The enquiry reveals that the offence in question appears to have been committed only by the officials of Trishul Electric and Powergen Limited. 4.The petitioner herein is the President of M/s.Ind Barath Energies (Thoothukudi) Limited and the said company had leased out the plant in question in favour of the said Trishul Electric and Powergen Limited and only after execution of such lease, the offence appears to have been committed. have played any role in the commission of offences. 5.Therefore, taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Tuticorin and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
