PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to issuance of the Passport based on the petitioner's application in File No.MD6066049829825, dated 05.01.2026.

ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to issue the passport to the writ petitioner based upon his application dated 05.01.2026.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in two criminal cases in Cr.No.376 of 2022 and Cr.No.278 of 2024 on the file of the second respondent police. In both the case, investigation is pending. So far charge sheet has not been laid.

3. The learned Government Advocate(crl.side) appearing for the second respondent also submits that the petitioner has been involved in another criminal case in Cr.No.388 of 2023 on the file of the Palani Town Police Station in which investigation is pending and so far charge sheet has not been laid.

4. This Court in a judgment reported in 2014 (8) MLJ 61 has held that mere pendency of FIR is not a legal impediment for issuance of the passport. 2/4

5. Considering the above said facts, the first respondent is directed to consider the request of the petitioner for issuance of the passport and pass orders within a period of four weeks from the date of receipt of a copy of this order.

6. With the above said observations, this writ petition stands disposed of. No costs.
