The present writ petition has been filed seeking a writ of mandamus directing the first to fifth respondents to forbear from issuing Building Plan Approval to the sixth respondent for constructing a building without considering the objections of the writ petitioner. 2/5

2. On a perusal of the records, it is revealed that there is a serious title dispute between the petitioner and the sixth respondent, and the sixth respondent has already commenced construction in the property over which the petitioner claims title.

3. If the petitioner is aggrieved by any unauthorised construction put up by the sixth respondent without obtaining building plan approval, it is open to the petitioner to approach the appropriate Division Bench dealing with matters relating to unauthorised constructions. Reserving the right of the petitioner, this writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
