PRAYER:- Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the 1st respondent to consider the petitioner's representation dated on 19.10.2020 within a time stipulated by this Court.

ORDER

This writ petition has been filed for issuance of writ of mandamus directing the first respondent to consider the representation made by the petitioner on 19.10.2020 and to pass orders within the time frame fixed by this Court.

2. The petitioner is seeking for issuance of assignment patta with respect to S.No.360/2 on the ground that the petitioner and his family members have been living for more than 17 years and have also put up a house and paying the tax.

3. When the matter was taken up for hearing, the learned Special Government Pleader produced written instructions received from the second respondent. On going through the same, it is seen that S.No.360/2 has a total extent of 00248 sq.mts. The said property was subdivided by the proceedings of the Tahsildar dated 27.02.2020 and accordingly, subdivided S.No.360/28 measuring 00069 sq.mts was allotted in favour of the petitioner. With respect to S.No.360/27 measuring an extent of 00120 sq.mts, it was allotted in favour of one Vellaiammal. Even after the allotment, the petitioner has not put up any construction and as on today, an extent of 00069 sq.mts., remains vacant. 2/4

4. The petitioner has nowhere stated in the affidavit about the above developments and he has approached this Court as if no allotment was made in favour of the petitioner.

5. Taking into consideration the written instructions received from the second respondent, no further orders are required to be passed in this writ petition except recording the same.

6. This writ petition is disposed of accordingly. There shall be no order as to costs.
