For Respondent : M/s.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- C-33AB. For Anticipatory Bail in Crime No.5/2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294-b, 448, 506(ii), 354 D(1) of IPC r/w Sec.4 of Women Harassment Act, in Crime No.5 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner disturbed the defacto complainant's daughter over phone and on 02.01.2022, he went to the defacto complainant's house and scolded her in front of her house. Hence, the complaint.

3.On the side of the petitioner it is stated that the petitioner and the defacto complainant's daughter had love affair

for the past three years while they were working in Pondicherry. After some time, there was a quarrel between them and the defacto complainant's daughter Vaishnavi went to her house at Trichy. Only at the insistence of the said Vaishnavi, the petitioner went to the defacto complainant's house at Trichy, when, the petitioner tried to meet the defacto complainant it ended in a wordy quarrel. Thereafter, the defacto complainant make such a false complaint. 4.On the side of the respondent it is submitted that there is a love affair between the petitioner and the defacto complainant's daughter.

5.Considering the submissions made on either side, this Court is inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is allowed and petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate No.VI, Trichy, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the concerned Court daily at 10.30 a.m. for a period of fifteen days. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
