Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct respondents 1 to 3 herein to conduct survey, fix and demarcate the public tank, natham lands, public road in Survey No.101/3, Kakkudi Village, Manamadurai Taluk, Sivagangai District, make necessary sub divisions thereof and annexure a portion of public tank lying in survey No.101/3 with other portions of Survey No.101/3, and consequently, forbear the 4th respondent herein from interfering with right of common enjoyment of the petitioner and other villagers in Survey No. 1/4

101/3 as per the representation of the petitioner dated 05.11.2019 within a reasonable time.

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted to direct respondents 1 to 3 to conduct survey, fix and demarcate the public tank, natham lands, public road in Survey No.101/3, Kakkudi Village, Manamadurai Taluk, Sivagangai District, make necessary sub divisions thereof and annexure a portion of public tank lying in survey No.101/3 with other portions of Survey No.101/3, and consequently, forbear the fourth respondent from interfering with the right of common enjoyment of the petitioner and other villagers in Survey No. 101/3.

2. The learned Government Pleader appearing on behalf of respondents 1 to 3, on instructions, would submit that survey has already been conducted in the subject property and boundary has also been fixed.

3. In view of the submission made by the learned Government Pleader, no further adjudication is required in this Writ Petition and the same stands closed. There shall be no order as to costs.
