Respondent/Complainant PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to modify the condition No.(ii) imposed by the learned Principal Sessions Judge, Theni as to deposit Rs.5 lakhs + Rs. 5 lakhs and Rs.3 lakhs in two months instead of Rs.13 lakhs in Crime No.35 of 2023.

ORDER

This petition has been filed seeking for modification of condition imposed at Para No.4 of the order passed by the learned Principal Sessions Judge, Theni.

2. When the petitioner was enlarged on bail, the Court below on considering the facts and circumstances and taking note of the fact that the case involved is job racketing, directed the petitioner to deposit a sum of Rs.13 lakhs based on the undertaking given by the petitioner.

3. This modification petition is filed seeking for payment of the said amount in three installments.

4. Taking into consideration the facts and circumstances and considering the reasons assigned by the petitioner, the condition imposed in para 4(iii) is modified to the effect that the petitioner will deposit a sum of Rs.5 lakhs initially. Thereafter, further sum of Rs.5 lakhs will be deposited within a period of four weeks after coming out on bail and the balance amount of Rs.3 lakhs will be deposited four weeks thereafter. To 2/4

that extent, the above condition is modified and the other conditions shall stand as it is.

5. With the above observations and directions, this Criminal Original Petition is disposed.
