O R D E R

The prayer in this writ petition is to direct the 3rd respondent to expedite the investigation on the complaint given by the petitioner, dated 06.12.2024.

2.The petitioner's father has purchased a property from one Jermaniammal, W/o.Late Joseph Servai and his legal heirs in survey Nos. 773/22, 773/23, 774/5 (total extent of 84 1⁄2 cents) on 27.10.1993. Thereafter, the petitioner's father passed away on 02.12.2022. The petitioner, his mother and his brother are being the legal heirs of his father. One Arockiammal sent a legal notice to the petitioner's father. Therefore, his father filed a suit in O.S.No.336 of 2001, which was ended in favour of the petitioner's father. Against which, the said Arockiammal filed an appeal and the same was dismissed on 08.01.2007. Thereafter, the petitioner and his family members are in possession and enjoyment of the properties. After the Court Judgments, the said Arockiammal and others had created forged documents viz.

, settlement deed, rectification deed and sale deed and criminally conspired for availing loan without any right. Without any verification, the Bank has also granted loan by mortgaging the aforesaid properties. In this regard, the petitioner has sent a representation to the 1st respondent on 06.12.

to the 2nd respondent, who in turn, forward the same to the 3rd respondent. However, there is no progress till date. Hence, this writ petition has been filed. 3.The learned Additional Public Prosecutor submitted that the complaint of the petitioner was received by the Dindigul Taluk police station, who enquired the same and since the petitioner's complaint has to be verified by the DCB II, Land Grabbing Cell, Dindigul, the petitioner was informed about the forwarding of his complaint to DCB II, Land Grabbing Cell, Dindigul. 4.In response, the learned counsel for the petitioner would submit that the petitioner would appear for enquiry before the DCB II, Land Grabbing Cell, Dindigul on 03.02.2025.

5.In view of the above, the petitioner is directed to appear for an enquiry before the DCB II, Land Grabbing Cell, Dindigul on 03.02.2025 along with the copy of complaint and supportive documents. The DCB II, Land Grabbing Cell, Dindigul is directed to conduct enquiry and complete the investigation within a period of three months from the date of receipt of copy of this order.
