To set aside the award dated 10.05.2011 passed by the I Additional District Court cum Motor Accident Claims Tribunal, Thanjavur in M.C.O.P.No.177 of 2009 so far as it relates to the disability of the appellant and quantum of loss of income and to fix Rs.10,00,000/- towards loss of income in addition to the amount already fixed.
ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.P.SESUBALAN RAJA, Advocate for the petitioner and of MR.J.S.MURALI, Advocate for the Respondent-3 the court made the following order:- This Civil Miscellaneous Petition has been filed to condone the delay of 1337 days in preferring the above appeal. https://hcservices.ecourts.gov.in/hcservices/
2. When the matter came up for hearing today, the learned Counsel appearing for the third respondent would submit that the
third respondent would submit that the third respondent is not having any serious objections in condoning the delay, on condigion that the petitioner/appellant shall not claim interest for the delayed period in the event of enhancement by this Court, which is also agreed by the learned Counsel appearing for the petitioner.
3. In Such a view of the matter, the delay is condoned and this petition is accordingly ordered.
