PRAYER : FOR BAIL IN CRIME NO.118 OF 2013 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody from November 2022 for the alleged offence punishable under Sections 120(B), 147, 148, 341, 302 r/w 149 IPC in Crime No.118 of 2013, on the file of the respondent Police, seeks bail.

2.The learned counsel appearing for the petitioner would submit that earlier the petitioner was arrested and released on bail and he was regularly 1/3

appearing before the trial Court without fail. While so, the petitioner was arrested by Erode Police Station for some other case and he was unable to appear before the trial Court. Hence, the learned Judicial Magistrate No.V has issued P.T.Warrant against the petitioner and he is in jail from November 2022. Therefore, he seeks bail. 3.The learned Additional Public Prosecutor appearing for the respondent Police would submit that this is second bail petition and there is no change in circumstances. Further he would submit that eight previous cases are pending against the petitioner and the application filed by the co-accused was also dismissed by this Court.

4.Heard both sides and perused the materials available in the record. 5.Considering the facts and circumstances of the case and considering the fact that there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.
