PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Certiorari, to call for the records pertaining to the impugned order issued by the third respondent in Na.KA.No. 5577/2023/Aa2 dated 03.01.2025 and quash the same as unconstitutional and arbitrary.

*********** [Order of the Court was made by M.S.RAMESH, J.] By consent of both sides, the writ petition itself is taken up for final disposal at the stage of admission itself. 2.This writ petition has been filed challenging the impugned order issued by the third respondent in Na.KA.No.5577/2023/Aa2 dated 03.01.2025.

3.As against the final eviction orders passed on 08.04.2024 under Section 6 of the Tamil Nadu Land Encroachments Act, 1905, the petitioner claims to have made a representation on 15.11.2024 to the District Collector and the same is pending. Though the petitioner herein seeks for quashing of the consequential order passed on 03.01.2025, which was pursuant to orders passed by the Coordinate Bench of this Court in W.P.(MD)No.29806 of 2023, filed by the third party, the learned Counsel for the petitioner submitted that he would be satisfied if the appellate authority is directed to treat the representation dated 15.11.2024 as the appeal and dispose of the same within a stipulated time.

4.In the light of the submissions made, the District Collector is directed to treat the representation of the petitioner dated 15.11.2024 as appeal and dispose of the same within a period of three [3] months from the date of receipt of a copy of this order.

5.Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
