ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 and A3 in Crime No.88 of 2015 on the file of the respondent police, were arrested and remanded to judicial custody on 25.07.2015 for the alleged offences punishable under Section 302 of I.P.C., and hence, seek bail. 2.According to the prosecution that the first accused had developed illicit intimacy with the second accused and they conspired together to murder her husband and accordingly on 18.07.2015, the first accused attacked the deceased with knife and caused his death and thereafter, with the help of the third accused, they destroyed the evidence.

3.The learned counsel for the petitioner submitted that the petitioners are innocent and they have been falsely implicated in this case. It is further submitted that the second accused is the employee of the first accused and even according to the prosecution, the fatal injury caused by the first petitioner/A1 and the second petitioner/A3 only helped the first accused for disposal of the body.

4.The learned Government Advocate (Crl.side) would submit that all the three accused in this case were arrested and the investigation is at initial stage and if they are released on bail, they will hamper further investigation.

5.However, considering the overt act attributed against the petitioners, this Court dismissed the application for the first petitioner/A1 and inclined to enlarge the second petitioner/A3 on bail on the following conditions.

6.Accordingly, the second petitioner/A3 is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Keeranoor, Pudukottai District and on further condition that the second petitioner/A3 shall report before the respondent police daily at 10.00 a.m., until further orders.
