PRAYER: Writ Petitions filed under Article 226 of the Constitution of India for issuance of a Writ of certiorarified mandamus to call for the records relating to the impugned suspension order issued by the 2nd respondent vide his proceedings Roc.No.P2/1082/2023 dated 03.07.2025 and quash the same as illegal and consequently direct the 2nd respondent to reinstate the petitioner into service by considering the petitioner's dated 17.09.2025, 24.10.2025, 24.11.2025.

ORDER

The petitioner, who is working as a Secretary of a Panchayat has been placed under suspension on 03.07.2025, pursuant to the registration of the criminal case in Crime No.139 of 2025 on the file of the Vachakarapatti police station for the offence under Section 194 of BNSS altered into Section 108 of BNS.

2.The petitioner with a grievance that he is in no way connected with the criminal case, however, based on the complaint of the deceased's wife, he has been mechanically implicated in the criminal case by the police, has filed this writ petition.

3.The learned Government Advocate appearing for the 2nd respondent submits that the petitioner has been placed under suspension pursuant to the registration of the criminal case in Crime No.139 of 2025. The petitioner has been paid with subsistence allowance. 2/5

4.This court has considered the rival submissions made. 5.The criminal case has been registered that the petitioner abused his subordinate, who was working as a pump operator and he has committed suicide. In this regard a criminal case has been registered in Crime No.139 of 2025, based on the complaint of the deceased's wife as against the petitioner for the offence under Section 108 of BNS. Mere uttering words would not constitute an offence under Section 108 of BNS and the investigation is yet to be completed. Considering the facts and circumstances of the case, the respondents shall consider the request of the petitioner and review the order of suspension.

6.With the above observation, this writ petition is closed. No costs. Consequently connected miscellaneous petition is closed. 11.02.2026 DSK 3/5
