ORDER

This Criminal Original Petition is filed to direct the respondent No. 1 and 2 to provide adequate police protection to direct the respondent herein to give police protection to the life and limb of the petitioner considering the complaint of the petitioner dated 19.07.2025.

Learned counsel for the petitioner submitted that the property in Survey No.69/1, new S.No.505/3 situated at Kulamangalam Village, Thirumayam Taluk, Pudukkottai District, belonged to the petitioner's great grandfather. After his demise, the petitioner is in possession and enjoyment of the property. In the year 2018, the property was wrongly alienated to the name of the third respondent by some third parties. Against the said registration, a writ petition in WP(MD)No.14731 of 2024 was filed before this Court and same was disposed of in favour of the petitioner. Aggrieved over the same, the third respondent is making 2/6

threat to the petitioner to restore the patta to his name. Therefore, seeking police protection, this Criminal Original petition came to be registered.

3. Learned Government Advocate(Crl.side) submitted that the property which the petitioner claims is an ancestral property. They made arrangements to give Annathanam on the day of Thaipoosam in the property. Due to the property dispute, the petitioner seeks police protection for the festival. He further submitted that against the order of this Court made in WP(MD)No.14731 of 2024, a Writ appeal in WA(MD)No.1330 of 2025, has been filed by the private respondents and an order of stay was granted.

4. The counsel for the petitioner submitted before this Court that he is unaware of the order of Stay passed by this Court in WA(MD)No. 1330 of 2025.

5. Heard both sides and carefully perused the materials available on record.

6. In view of the submissions made by either side, the petitioner is directed to workout remedy before the Hon'ble Division Bench and appropriate civil court, in this regard.

7. With the above observations, this Criminal Original Petition stands dismissed.
