ORDER
This Criminal Original Petition is filed to direct the 3rd and 4th respondents police not to harass the petitioner and his family members in guise of enquiry, based on the petitioner representation on 17.01.2026.
2. Learned counsel for the petitioner submitted that the fourth respondent, without any summons required the petitioner to appear before the third respondent police station and directed him to pay an amount of Rs.5,00,000/- to one Somasundaram without any basis. Hence this petition.
3. Learned Government Advocate (Crl.side) submitted that the petitioner has acted as a broker in selling second hand vehicle. One Somasundaram purchased a TATA Intro vehicle bearing registration No. TN 72 CP 9414, through the petitioner from one Senthil Kumar and at the time of purchase it was informed that the loan was already closed. But later the Bank authorities have hypothecated the vehicle from the 2/4
said Somasundaram. Therefore, the case came to be registered and CSR has been issued. The petitioner appeared for the enquiry and given an undertaking that he will settle the money within a month or he will give a new vehicle to the said Somasundaram. Instead of complying his undertaking, the petitioner has come forward with the present petition seeking not to harass him.
4. From the submissions made by both sides, it is clear that it is a dispute with respect to a sale of TATA Intro vehicle bearing registration No. TN 72 CP 9414. In view of the submission made by the learned Government Advocate, that they have called the petitioner only for enquiry, by serving summons, the petitioner is directed to cooperate with the ongoing enquiry.
5. With the above direction, this Criminal Original Petition is disposed of.
