(CRIME NO. 4 OF 2015) ..RESPONDENT/COMPLAINANT For Petitioner : M/S AJMAL ASSOCIATES Advocate For Respondent : M/s.S.PRABHA, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 468, 471 and 420 of the Indian Penal Code in Crime No.4 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2. According to the defacto complainant that the accused has produced fake transfer certificate for renewal of his passport and the Headmaster, Government Higher Secondary School, Mirattunilai has stated that he has not issued the certificate.

3. The learned counsel for the petitioner submitted that the petitioner was already issued passport by the Competent Authority and he entrusted the passport to the agent for renewal and mistake was committed by the agent. The learned counsel further submitted that he is the bread winner of the family and he has not committed any offence.

4. The learned Government Advocate (Criminal Side) has also submitted that the earlier applications have been dismissed by this Court and as per the complaint, the petitioner has submitted application for renewal of passport with fake certificate and it is further submitted that he has no bad antecedents.

5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Ramanathapuram and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
