To prefer this Memorandum of Second Appeal against the judgment and Decree made in A.S.No.354 of 2003 on the file Principal District Judge, Tiruchirappalli dated 30.09.2004 reversing the Judgment and Decree made in O.S.No.312/1996 on the file of the II Additional Subordinate Judge, Tiruchirappalli dated 24.09.2003. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.P.RAJAGOPALAN, for MR.R.DEVARAJ, Advocate for the petitioner and of MR.R.GUNASEKAR Advocate for M/S.SARVABHUMAN ASSOCIATES(LAW FIRM) on behalf of the Respondent, the court made the following order:- This civil miscellaneous petition has been taken out by the sole appellant in S.A(MD)No.284 of 2005. To be noted, S.A(MD) No.284 of 2005 is tagged with S.A(MD)No.285 of 2005, wherein this sole appellant is first appellant.

2.Instant civil miscellaneous petitioin has been filed with a prayer for fixing an early date on the ground that the petitioner [sole appellant in S.A(MD)No.284 of 2005 and first appellant in S.A (MD)No.285 of 2005] is 67 years old.
