ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the impugned order passed by the 2nd respondent vide his proceeding in Na.Ka.No. 4140/E2/2021 dated 14.03.2022 and consequential order passed by the 1st respondent vide his proceeding dated 27.12.2023 in Na.Ka.No . 2596/Aa4/2022 and consequently directing the respondents 1 and 2 to pass appropriate orders.

2. Through the impugned order, the respondents have considered the contentions of both the petitioners and the private respondents and have directed the parties to approach the competent civil court. The only allegation submitted by the petitioners is that the 4th respondent herein had already filed a civil suit in O.S. No. 49 of 2011 on the file of the Sub Court, Uthamapalayam. However, the respondents have denied the same. Therefore, the petitioners have filed the present writ petition. As on date, the suit has been taken on file and is being conducted by the parties on a regular, day-to-day basis.

3. In view of the above, this writ petition is disposed of. The impugned order passed by the 2nd respondent vide proceedings in Na.Ka.No. 4140/E2/2021 dated 14.03.2022 and the consequential order passed by the 1st respondent vide proceedings dated 27.12.2023 in Na.Ka.No.2596/Aa4/2022 are 3/6

hereby confirmed. The petitioners and the private respondents are directed to put forth their respective contentions in the suit. The suit proceedings in O.S. No. 49 of 2011 shall be completed on or before 27.02.2026. There shall be no order as to costs.
