O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent herein to remove the name of Suruli, S/o. Kathiri, from the joint patta wrongly issued and to issue an exclusive patta in favour of the petitioner, after completing the enquiry within the stipulated time to be fixed by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fourth respondent, as no adverse orders are proposed to be passed against him.
3. The grievance of the petitioner is that the petitioner purchased the subject property on 13.07.2023. From the date of purchase, the petitioner has been in possession and enjoyment of the same. The Page No. 2 of 6
petitioner applied for mutation of the revenue records and issuance of patta in his name before the second respondent. However, a joint patta was wrongly issued, including the name of one Suruli, S/o.Kathiri, though the said Suruli had already alienated the property in the year 2003 to the petitioner's predecessor-in-title and has no subsisting right over the subject property.

Therefore, the petitioner submitted a representation dated 02.03.2024 to the second respondent seeking removal of the name of the said Suruli from the joint patta and issuance of exclusive patta in the name of the petitioner. The second respondent initiated enquiry proceedings by issuing summons dated 25.05.2024 to the fourth respondent, who is the son of the said Suruli, to appear and produce the original documents. Further, several summons were issued to the fourth respondent.
5. The second respondent also directed the third respondent to conduct an enquiry and submit a detailed report. Accordingly, the third respondent submitted a report to the second respondent stating that the said Suruli has no title, right or interest in the subject property. However, the second respondent has not passed any order till date and has kept the Page No. 3 of 6
enquiry pending. Therefore, the petitioner has been constrained to file the present Writ Petition.
6. The learned Government Advocate appearing for the first to third respondents, on instructions, would submit that the enquiry on the petitioner's representation would be completed and appropriate orders would be passed by the second respondent within a period of twelve weeks.
7. Recording the above submission and without expressing any opinion on the merits of the matter, this Court directs the second respondent to conclude the enquiry on the petitioner's representation and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. This Court also directs the second respondent to provide a reasonable opportunity of hearing to the petitioner, the fourth respondent and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. Page No. 4 of 6
8. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
