ORDER

This Criminal Original Petition has been filed to set aside the order passed by the learned Principal Special Court for Exclusive Trial of Cases under POCSO Act, Thanjavur, in Crl.M.P.No.1498 of 2022 in Spl.S.C.No.53/2020 dated 19.12.2022.

2.Recalling petition was filed before the trial Court to recall P.W.1 for further cross examination that was dismissed by the trial Court on 19.12.2022, against which, this petition has been filed.

3. This Court is not in a position to understand the grievance that was expressed by the petitioner, since in the trial Court, on cross examination of victim girl, the victim girl fully supported the defence. With regard to the other aspects, the petitioner wants to recall the Medical Officer who examined the victim girl. Absolutely, there is no necessity. I find no reason for recalling of P.W.1 for further cross examination.

4. With the above, this Criminal Original Petition is dismissed. Consequently, connected Miscellaneous Petition is closed. 05.04.2023 NCC :
