Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehend arrest at the hands of the respondent for the alleged offence punishable under Sections 341,147,148,427, 324 and 302 of IPC in Crime No.10 of 2019 seek anticipatory bail.

2. The case of the prosecution is that the petitioner and the deceased are doing same business and there was previous enmity between the petitioner and the deceased in which the petitioner had engaged other accused persons to commit the murder and thereby they joined together and committed the murder. Hence the defacto complainant's friend had filed a complaint before the respondent police.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would also submit that there is no specific overt act against this petitioner and prayed for anticipatory bail.

4. The learned Government Advocate (Crl.Side) would submit that the petitioner is the main accused and he only arranged other persons to commit the murder of the deceased investigation is at the preliminary stage and opposed for grant of anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/

5.Taking into consideration the facts and circumstances of the case and also considering the fact that there are specific allegations against this petitioner and if he is released on bail, he will tamper the witness, this Court is not inclined to grant anticipatory bail to the petitioner.
