ORDER

This Criminal Original Petition has been filed praying to quash the proceedings in Crime No.621 of 2014 pending investigation on the file of the first respondent police.

2.On a complaint of the 2nd respondent/defacto complainant, the 1st respondent registered case in Crime No.621 of 2014 for offences under Sections 465, 468, 471 and 420 of I.P.C. The allegation is that the petitioners had received moneys from the defacto complainant for securing him a Certificate of having passed 9th standard towards his being eligible for a heavy duty driving licence. The certificate https://hcservices.ecourts.gov.in/hcservices/ obtained by the petitioners is alleged to be a false one.

3. Now a memo of compromise is filed duly signed by the parties as well as by the respective learned counsels stating that the matter in issue has been amicably resolved and therefore, the complainant is not willing to prosecute the case.

4. The Court has also heard the learned Government Advocate(Crl. Side) appearing for the State and perused the materials available on record.

5. Fearing possibility of the petitioners indulging in such practices against several persons, this Court has ascertained from the learned Government Advocate(Crl. Side) that the present is the only case against the petitioners.

6. Considering the nature of the case and that the petitioners are not accused of any offence of similar nature, this Court would accept the memo of compromise filed by the parties.

In the result, this Criminal Original Petition is allowed and the proceedings in Crime No.621 of 2014 on the file of the Inspector of Police, Chinnamanur Police Station, Theni District, are hereby quashed.
