This Criminal Original Petition has been filed to quash the impugned notice/summons dated 23.01.2024 issued by the first respondent to the petitioner pursuant to the complaint lodged by the third respondent.

2. The learned Government Advocate (Criminal Side) for the first and second respondents, on instructions, would submit that an FIR in Crime No.13 of 2024 has been registered against the petitioner for the offence punishable under Section 380 of the Indian Penal Code, 1860; and that pursuant to the investigation, a final report has been filed before the learned Chief Judicial Magistrate, Tenkasi, in C.C.No.1095 of 2024.

3. In view of the above, nothing survives for adjudication in this Criminal Original Petition. Therefore, this Criminal Original Petition is Page No. 2 of 4

dismissed as infructuous with liberty to the petitioner to challenge the final report, if so advised. Consequently, the connected Miscellaneous Petition is closed.
