ORDER

This Criminal Original Petition has been filed to direct the respondent to register a case based upon the complaint given by the petitioner dated 08.12.2017.

2.Heard the learned counsel for the petitioner and learned Government Advocate(Crl.side), appearing for the respondent. 3.The learned counsel for the petitioner has submitted that the petitioner is the owner of a land in T.S.No.1464/1.C measuring about one acre in Hanumanthanpatti village. He further submitted that one Sonai tried to trespass on 08.12.2017 and caused damage to the said property and hence the petitioner has lodged a complaint before the police on 08.12.2017, but so far no action being taken.

4.The learned Government Advocate(Crl. Side) has submitted that the dispute is with regard to civil dispute. https://hcservices.ecourts.gov.in/hcservices/ 5.By way of reply the learned counsel for the petitioner has submitted that if the said dispute is civil in nature how the

respondent has registered a case based upon the complaint given by the opposite party on the same set of facts and hence requested the court to give direction to the respondent to register a case. 6.Considering the aforesaid submissions, the respondent is directed to enquire the matter and if the enquiry reveals any cognizable offence, he has to register a case and proceed in accordance with law.

7.With the aforesaid observations, this Criminal Original petition is disposed of.
