O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first and second respondents to conduct a survey, demarcate the boundaries and fix boundary stones in respect of the land comprised in Survey No.7/3A1, situated at K.Nedungulam Village, Kariyapatti Taluk, Virudhunagar District, with the assistance of the third respondent police, by considering the petitioner's representation dated 16.10.2025, within the time to be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself. Page No. 2 of 6

3. The learned counsel appearing for the petitioner would submit that an online application has been submitted for the survey of the property in question and for demarcation of its boundaries and a representation has also been submitted.

4. The learned Special Government Pleader appearing for the first and second respondents, on instructions, would submit that notices were issued to the petitioner pursuant to the application made by the petitioner on 09.10.2025; that however, the petitioner did not appear for the enquiry/survey and therefore, the statutory time limit of 90 days for conducting the survey expired; and that if the petitioner makes a fresh application, the same will be considered and after considering the claims of all the parties, necessary steps would be taken to survey and demarcate the land in question in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. Recording the aforesaid submissions, this Court directs the petitioner to make a fresh application for survey and demarcation of the property, if the petitioner intends to have the land surveyed. If the petitioner makes such an application, the first and second respondents Page No. 3 of 6

shall consider the same, survey and demarcate the petitioner's land after considering the claims of all parties and pass appropriate orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of such application. In the event of any rival claims, the parties are at liberty to work out their remedies before the competent Civil Court. It is needless to state that before conducting the survey, notice shall be issued to the adjacent landowners and other interested parties and if required, police assistance may also be taken.

6. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
