ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 457 and 380 I.P.C., in Crime No.275 of 2017 on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that the petitioners along with other accused broke open the TASMAC Shop No.7682, Keeladi, Sivagangai District and taken away the liquor bottles. 3.The learned counsel appearing for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case and prays for grant of anticipatory bail to the petitioners.
4.The learned Government Advocate (Criminal Side) submitted that the investigation is still pending.
5.The submissions made by the learned counsel appearing on either side are considered. The petitioners along with other accused committed the theft of brandy bottles worth about Rs.1,74,300/-. As of now, other accused was arrested and the property worth about Rs.60,000/- alone is recovered. As per the case of the prosecution, remaining property should be recovered only by way of investigation https://hcservices.ecourts.gov.in/hcservices/
from these accused. So, as per the submission made by the learned Government Advocate (Criminal Side), custodial interrogation of the petitioners is necessary for completing the investigation, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 12/01/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
