Respondents P RAYER : Petition filed under Article 226 of the Constitution of India, o issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the order passed by the fifth respondent Na.Ka.No. 026/2024/a2 dated 18.01.2025 and quash the same as illegal and subsequently directing the second respondent Department to conduct the Kumbabisegam of Sri Chekkadi Siva Temple situated in Ettimangalam Village, Melur Taluk and maintain the temple in the future. ORDER

This Writ Petition has been filed challenging the impugned order passed in the peace committee meeting in front of the fifth respondent dated 18.01.2025.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The temple, viz., Sri Chekkadi Siva Temple situated in Ettimangalam Village, Melur Taluk, in which the petitioner is claiming to be one of the Ambalakar. While being so, there is a dispute between the community peoples, since the temple worship by all community people of village. The temple situated at Government land, as per the revenue records and classified as "Government Poromboke "(tz;bg;ghij) . While being so, the petitioner and the respondents 7 and 8 have dispute in respect of receiving right over the temple. In this regard, on the complaint, the fifth respondent conducted peace committee meeting and some of the resolutions were resolved between 'A' party and 'B' party, which is under challenge in this writ petition.

4. Admittedly, both A party and B party appeared before the fifth respondent and they themselves passed some resolution in front of the fifth respondent. Therefore, the resolution has no legal sanctity and it can be used only for evidenciary value. If at all aggrieved by any resolution resolved by the parties, they can approach the civil Court for appropriate relief. Therefore, it cannot be challenged before this Court 3/6

and the writ petition is devoid of merit and the same is liable to be dismissed.
