Respondents 2 to 5 PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, against the order passed in C.M.A.No.2 of 2020, dated 06.11.2023, on the file of the Subordinate Judge, Manapparai, Trichy District and confirming the order passed in E.A.No.7 of 2005 in E.P.No.48 of 2004 in O.S.No.575 of 2000, on the file of the District Munsif Court, Manapparai, dated 21.10.2011. ORDER

The revision petitioner herein is a third party to O.S.No.575 of 2000, on the file of the District Munsif Court, Manapparai, Trichy. 2.The first respondent in the revision petition had filed the above said suit for the relief of maintenance and charge over the schedule mentioned properties. The suit was decreed. In order to execute the decree, the first respondent had filed E.P.No.48 of 2004. Pending execution proceedings, the revision petitioner herein as petitioner had filed E.A.No.7 of 2005 to raise the order of attachment. This application was dismissed by the executing Court. Challenging the same, she had filed C.M.A.No.2 of 2020 on the file of the Sub Court, Manapparai. The appeal was also dismissed. Challenging the same, the present revision petition has been filed. 3.

According to the learned Counsel appearing for the revision petitioner, E.P.No.48 of 2004 was dismissed by the executing Court on 18.04.2024. In such circumstances, nothing survives to be adjudicated in the present revision petition. Accordingly, this Civil Revision Petition stands closed. No costs. Consequently, connected miscellaneous petition is also closed.

4.In case, if it is revived, the revision petitioner would be at liberty to approach this Court again.
