ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the respondent to file a final report in connection with the Crime No.313 of 2022 on the file of the respondent police within the time stipulated by this Court.

2. When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondent would submit that the respondent, after completing the investigation, has laid the final report dated 15.09.2022 in Crime No.313 of 2022 as 'Mistake of Fact'. He would further submit that RCS notice was not served on the petitioner/defacto complainant.

3. The learned counsel appearing for the petitioner would submit that two FIRs came to be registered in Crime Nos.312 of 2022 and 313 of 2022 and both the cases are case and case in counter. 2/4

4. At this juncture, the learned Government Advocate (Criminal Side) appearing for the respondent would submit that in Crime No.312 of 2022, investigation has already been completed and they are going to file charge sheet shortly.

5. Recording the submission made by the learned Government Advocate (Criminal Side), the respondent is directed to serve RCS notice on the petitioner/defacto complainant and the petitioner is at liberty to file a protest petition, if so advised before the jurisdictional Court.

6. With the above direction, this Criminal Original Petition stands disposed of.
