ORDER

These Civil Revision Petitions have been filed challenging the orders dated 22.08.2025 made in I.A.Nos.12 and 13 of 2025 in H.M.O.P. No.176 of 2021 on the file of the Family Court, Thanjavur. 1/4

The learned counsel for the revision petitioner/husband submitted that the petitioner/husband has filed a petition for restitution of conjugal rights, whereas the respondent/wife has filed a petition for divorce. In such circumstances, the wife filed two applications seeking to recall and reopen the petitioner's side witness and to mark certain documents, namely the plaint and written statement in O.S.No.285 of 2022 on the file of the Principal Sub Court, Kumbakonam. The said applications were allowed by the trial Court on 22.08.2025.

According to the revision petitioner, if the said documents, namely the plaint and written statement in O.S.No.285 of 2022 on the file of the Principal Sub Court, Kumbakonam, are taken on file, it will have a serious impact and derail the trial. Further, those documents are totally irrelevant to the present matrimonial proceedings and have been sought to be marked only to protract the proceedings. Hence, the orders passed by the learned Judge, Family Court, Thanjavur are liable to be set aside.

4. The trial Court has taken into consideration that the marking of such documents is only to prove the necessity of the case. In a divorce proceeding between the husband and wife, marking of connected 2/4

documents pending before the Principal Sub Court, Kumbakonam, will not cause any prejudice to the revision petitioner/husband.

5. In view of the above, this Court does not find any reason to interfere with the orders passed by the trial Court. Accordingly, these Civil Revision Petitions are dismissed. No costs. 30.01.2026 NCC : Yes / No Index : Yes / No Internet : Yes / No Indu To 1.The Family Court, Thanjavur.
