ORDER
This Writ Petition has been filed seeking a Mandamus to direct the 2nd respondent to consider the petitioner's representation, dated 04.01.2025 and take appropriate action.
2. Mr.A.Thiruvadi Kumar, learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.
3. I have considered the submission of the learned counsel appearing for the writ petitioner and the learned Additional Public Prosecutor appearing for the respondents.
4.The petitioner is the President of Oorani Thamarai Vall Dharma Sastha Temple Trust. Since the previous administrator of the temple taking actions to stall the Kumbabhishegam and refused to return the valuable properties of the temple such as gold, silver and other pooja articles. In this regard, the petitioner has sent a representation to the 2nd respondent, however, the same was not considered. Hence, this writ 2/5
petition has been filed.
5.The learned Additional Public Prosecutor on instructions submitted that though the petitioner has sent a representation through post, failed to appear before the respondent police for enquiry. 6.In response, the learned counsel for the petitioner submitted that the petitioner is ready to appear for enquiry before the 2nd respondent on any date fixed by this Court. The temple festival is scheduled on 02.02.2025, prays to take action before that date. 7.In view of the aforesaid submission, the petitioner is directed to appear before the 2nd respondent for enquiry on 28.01.2025 at 11 a.m., and submit all the relevant documents. The 2nd respondent is directed to conduct enquiry by ensuring the presence of the counter part and pass appropriate orders on or before 02.02.2025. 3/5
8. With the above directions, this Writ Petition stands allowed.
