Respondent/Respondent/Complainant Prayer in Crl MP(MD).NO.1657/2022:- Criminal Miscellaneous Petition is filed U/Sec.482 of Cr.PC., to extend the time granted by this court in Crl R.C No. 651 of 2021 dt. 20.09.2021 to pay Rs. 1,00,000/- to the credit of the Chief Justice Relief fund (payable in Accounts section of the High court Registry) Prayer in Crl. RC(MD).No.651 of2021:- This Criminal Revision has been filed under Section 397 and 401 of Criminal Procedure Code, to call for records relating to the order in Crl.MP.No.3606 of 2021 passed by the Principal Sessions Judge, Kanyakumar District at Nagercoil, dated 24.08.2021 in respect of condition No.1 alone ;and set aside the same.

ORDER:- This Revision/Appeal Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Thiru.K.P. Narayanakumar, Advocate for the Petitioner and of Thiru.R.Sureshkumar, Government Advocate for the respondent, this Court made the following order:

This petition has been filed to extend the time for the petitioner to comply with the conditional order, dated 20.09.2021, in Crl.R.C.(MD)No.651 of 2021.

2.The petitioner filed the petition for return of property in Crl.MP No.3606 of 2021 before the learned Principal Sessions Judge, Kannyakumari District at Nagercoil. That petition was allowed by the trial Court on certain conditions. The petitioner was directed to execute a bond for a sum of Rs.22,00,000/- (Rupees Twenty Two Lakhs Only). Against that condition, the petitioner filed a petition 1/3

before this Court in Crl.RC (MD) No.651 of 2021 and this Court modified the first condition and the petitioner was directed to deposit Rs.1,00,000/- (Rupees one lakh only), within a period of two weeks. The petitioner was not able to comply with the condition, within the time limit prescribed by this Court and prayed the time limit to be extended.

3.On the side of respondent, there is no objection. 4.In view of submissions made by both sides, this Court is inclined to extend the time limit to deposit the amount, as ordered by this Court within two weeks, from the date of receipt of copy of this order.
