O R D E R

This Criminal Original petition has been filed to direct the first respondent not to harass the petitioner and her family members under the guise of enquiry, based upon the complaint given by the second respondent.

2. Heard both sides.

3. The learned counsel appearing for the petitioner has submitted that the second respondent gave a complaint before the first respondent stating that the petitioner's husband made request to the second respondent to stand as guarantor for availing a loan of Rs.13,12,000/- from the Bank and subsequently, since the petitioner's husband died, the second respondent gave a complaint before the first respondent to pay the said amount and based on the said complaint, the first respondent is harassing the petitioner and his family members.

4.The learned Government Advocate (Crl.side) has submitted that after receipt of the complaint from the second respondent, enquiry has been commenced and the petitioner also appeared for enquiry and the complaint will be disposed of, after completing the enquiry. further submitted that the petitioner was not subjected to any harassment.

5.Considering the aforesaid submissions, the first respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, he can register a case and proceed with the same, in accordance with law. However, the petitioner should not be subjected to any harassment, during enquiry.

6.With the aforesaid observation, this Criminal Original Petition is disposed of.
