ORDER : The Court made the following order :- The petitioner/A1 and A2 herein were arrested and remanded to judicial custody on 12.05.2020, for the offence under Sections 8(c) r/w 20(b), (ii) (B) of NDPS Act, 1985, in Crime No.682 of 2020, on the file of the respondent Police, seeks bail. 2.The case of the prosecution is that the petitioners and other accused were found in possession of 20 kgs of Ganja. Hence, the crime has been registered.
3.The learned counsel appearing for the petitioners submitted that totally there are five accused in this case. He further submitted that it would suffice, if a direction to be issued to the trial Court to complete the trial within a stipulated period. 4.The learned Government Advocate (Crl. Side) appearing for the respondent Police submitted that the investigation has been completed and final report has been filed and the same has been taken on file in C.C.No.35 of 2020 by the II Additional District Judge, Special Court for NDPS Act cases, Thanjavur. submitted that 20 kgs of contraband have been seized, which is under commercial quantity. He further submitted that the petitioners are having four previous cases and History Sheeted Rowdy Book was opened against them.
5.Considering the submission made by the learned counsel appearing for the petitioners, the II Additional District Judge, Special Court for NDPS Act cases, Thanjavur is directed to conduct the trial in C.C.No.35 of 2020 on day to day basis and complete the same within period of six months from the date of receipt of a copy of this order.
6.In view of the above direction, this criminal original petition stands disposed of.
