JUDGMENT

(Judgment of the Court was made by G.R.SWAMINATHAN, J.) Heard both sides.

2.The State has filed the writ appeal challenging the order dated 21.12.2023 passed by the learned single Judge allowing the writ petition. The writ petitioner was assigned with certain pieces of land. The details are as follows:

3.The assignments were cancelled some 21 years later on the ground that the assigned lands were not brought to cultivation within three years. The learned single Judge concluded that if on this ground the assignments were to be cancelled, a spot inspection must have been held immediately on the expiry of the third year and thereafter cancellation order should have been passed. In this case, the orders were passed belatedly. On this ground, the learned single Judge chose to set aside. We do not want to interfere with the same.

4. The writ appeal stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
