Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents 1 to 3 not to issue the work order to the fourth respondent in pursuance of the tender notification in Na.Ka.No.150/2020, dated 28.12.2020 and consequently, directing the respondents 1 to 3 to conduct a fresh tender cum auction by giving a new tender notification in respect of serial No.1 based on the petitioner's representation dated 02.02.2021.

ORDER

Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the first respondent and the learned Government Advocate appearing for the respondents 2 & 3.

2.The prayer in the Writ Petition is for restraining the authorities from issuing any work order in favour of the fourth respondent.

W.P.(MD)No.2245 of 2021 3.When the matter was taken up for hearing, it is submitted by the learned Special Government Pleader that the work order was already issued on 22.01.2021. Therefore, the prayer has become infructuous at the very inception.

4.The Writ Petition is dismissed. The first respondent is directed to serve the copy of the work order on the learned counsel for the petitioner, so that, if the petitioner is still aggrieved, he can quash the same in the manner known to law. No costs.
