O R D E R

This Petition has been filed by the petitioner to direct the second respondent to register a case, based on the complaint given by the petitioner on 01.12.2017 2.The learned counsel for the petitioner has submitted that after demolishing the old compound wall, the petitioner has constructed a new compound wall in his property but the proposed accused has damaged the said wall and criminally intimidated the petitioner by using filthy words and hence a complaint was lodged before the second respondent on 01.12.2017 but so far no action has https://hcservices.ecourts.gov.in/hcservices/ been taken.

3.The learned Government Advocate (Crl.Side) has submitted that after receipt of the complaint the petitioner was called upon for enquiry but he did not appear and he is not cooperating for enquiry and hence the said complaint is still pending. 4.The petitioner is directed to appear before the second respondent on 30.01.2018 and on such appearance the second respondent has to enquire the matter and if the enquiry reveals any cognizable offence then he has to register a case and proceed in accordance with law. In case the petitioner fails to appear on 30.01.2018 then it is open to the second respondent to drop further proceedings on the said complaint.

5.With the aforesaid observations, this Criminal Original Petition is disposed of.
