Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.KRISHNASAMY.P, Advocate for the petitioner and of MR.P.KOTTAICHAMY, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- Heard both sides.

2.Considering the submissions made on either side, the condition already imposed on the petitioner is modified to the effect that the petitioner shall deposit a 1/3

sum of Rs.10,000/- (Rupees Ten Thousand only) through Demand Draft to the credit of the Chairman / District Collector, District Mineral Foundation Trust of the concerned District, without prejudice to his defence before the trial Court and the learned Judicial Magistrate after perusing the challan / receipt, shall accept the sureties furnished by the petitioner.
