PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the respondents 1 to 4 to provide adequate Police protection to the petitioner and family members from the respondent Nos.5 to 8 on the basis of the petitioner's petition dated 09.02.2019 and 15.02.2019. O R D E R

The present petition seeks protection of his life, liberty and right to the property at the hands of the respondents 5 to 8. 2.The learned counsel appearing for the petitioner submitted that earlier the respondents 5 to 8 has laid O.S.No.232 of 2005, before the District Munsif Court, Srivilliputhur. He further submits that the petitioner has already laid O.S.No.253 of 2011, against the nine defendants of whom, the present respondents 5 to 8 were the defendants 3 to 6. The said suit was laid for partition and decree for injunction was granted in favour of the petitioner https://hcservices.ecourts.gov.in/hcservices/

as against the defendants 3 to 9 with regard to item nos.3 to 5 of the suit properties alone. Despite suffering a decree for injunction as regards item nos.3 to 5, the present respondents 5 to 8 pose threat to the petitioner's life, liberty and enjoyment of the suit property.

3.The learned Additional Public Prosecutor appearing for the respondents 1 to 4 submitted that a complaint dated 15.02.2019 is pending with the third respondent Police and it is being enquired in C.S.R.No.179 of 2019.

4.Considering the facts of the case, the third respondent is now required to cause such necessary enquiry after putting the respondents 5 to 8 on notice and take such appropriate decision as may be necessary to protect the life, liberty and right to property of the petitioner to that extent covered by the decree in O.S.No.253 of 2011 and no more.

5.In view of the above, the Criminal Original Petition stands disposed of.
