ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.2, in Crime No.53 of 2015 on the file of the respondent police, was arrested on 28.07.2015 for the alleged offences punishable under Sections 406, 468, 471 and 420 of I.P.C., and hence, seeks bail.
2. According to the de-facto complainant, that the accused have sold the property to an extent of 1 1⁄2 cents in Survey No.70 of Thotanur Village showing fake patta for Rs.80,000/- and thereby cheated the defacto complainant.
3. The learned counsel for the petitioner submitted that the patta was issued by the competent authority and he was not aware that it is a fabricated document. The learned counsel for the petitioner further submitted that without prejudice to the right of the petitioner, he is ready to deposit the entire amount of Rs.80,000/- to the credit of the Crime No.53 of 2015.
4. The learned Government Advocate (Crl.side) submitted that the defacto complainant has coming from most backward community and she was cheated by the accused and it is further submitted that the investigation is still pending.
5. However, considering the submission of the learned counsel for the petitioner, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Madurai and on further condition that the petitioner shall deposit Rs.80,000/- (Rupees Eighty Thousand only) to the credit of Crime No.53 of 2015 before the learned Judicial Magistrate No.I, Madurai within a period of two weeks from the date of his release from the jail and the petitioner shall https://hcservices.ecourts.gov.in/hcservices/
appear before the respondent police daily at 10.00 a.m. for a period of two weeks.
