PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, directing the third respondent to provide adequate Police protection to the life and limb of the petitioner and his family members by considering his representation dated 05.03.2019.

O R D E R

The present petitioner alleges that the respondents 3 to 6 are river sand smugglers. They trespassed into the petitioner's property to transport the river sand which they quarried illicitly. They pose serious threat to the petitioner's life, liberty and right to his property and hence he has preferred a complaint to the respondent Police on 05.03.2019.

2.The learned Additional Public Prosecutor concurred with the said submission made by the petitioner.

3.Considering the facts of the case, the third respondent is now required to cause such necessary enquiry on the complaint preferred by the petitioner and take such appropriate decision to ensure to protect the petitioner's life, liberty and right to https://hcservices.ecourts.gov.in/hcservices/

property. In addition, the third respondent is also directed to focus his attention on the other aspect of the allegation made by the petitioner in that he has made a positive statement that the respondents 4 to 6 are engaged in illicit quarrying of river sand and smuggling the same. The second respondent is directed to monitor not only the enquiry now directed to be carried out by the third respondent but also on the angle of alleged illicit quarrying of the river sand by the respondents 4 to 6.

4.In view of the above direction, the Criminal Original Petition stands disposed of.
