PRAYER:- Writ Petition - filed under Article 226 of the Constitution of India, praying this Court to issue a writ of Certiorarified Mandamus, calling for the records in pertaining to the impugned refusal check slip of the second respondent in RFL/Thuvarankurichi/6/2025 dated18.06.2025 quash the same as illegal, consequently direct the second respondent to register the document presented by the petitioner in respect of Survey No.236/1L for an extent of 23 Cents situated at Yagapuram Village, Marunapuri Taluk, Trichy District.

ORDER
The writ petition has been filed challenging the impugned order dated 18.06.2025.
2. When the petitioner presented a sale deed for registration, registration of the same was refused on the ground that the property stood attached pursuant to an order passed by the learned First Additional Subordinate Judge, Tiruchirappalli.
3. The learned counsel appearing for the petitioner submitted that, upon verification, it was found that a suit had been filed by one Ayyathurai, S/o.Nala Gounder, for recovery of money. The suit claim related to a borrowal of Rs.30,000/-. Subsequently, an ex parte decree came to be passed and, in E.P.No.65 of 2003, the property in question was attached.
3. The learned counsel further submitted that, while attempting to alienate the property, the petitioner made efforts to trace the decree-holder. However, it was found that the decree-holder is no longer alive and that none of his legal heirs could be traced. The petitioner is ready and willing to 2/5
satisfy the decree in full by depositing the entire amount due under the decree. According to the petitioner, the total amount payable towards the decree, including interest and costs, is Rs.1,23,883/-. The petitioner expresses readiness and willingness to deposit the said amount in full.
4. In view of the above submission, this writ petition is disposed of on the following terms:
(i) It is stated that the Execution Petition has since been transferred to the file of the District Munsif Court, Manapparai. The petitioner shall approach the said Court and file an appropriate memo expressing willingness to satisfy the entire decree amount, together with interest and costs, and shall also file a calculation memo.
(ii) The learned District Munsif, Manapparai, shall, after issuing notice to the counsel appearing for the decree-holder and following due process, determine the correctness of the calculation and permit the petitioner to deposit the amount found due under the decree.

(iii) Upon such deposit, the learned District Munsif, Manapparai, shall pass appropriate orders recording the deposit / payment to the satisfaction of the decree.
(iv) Thereafter, the petitioner shall obtain a certified copy of the order and re-present the document before the second respondent along with the said certified copy.
(v) Upon such re-presentation, the second respondent shall register the document, provided there is no other legal impediment. No costs.
