PRAYER : Civil Revision Petition is filed under Article 227 of Constitution of India, to direct the Principal District Judge, Tiruchirapalli to dispose of the I.A.No.4/2022 in Arb.O.P.No.43/2021. For Petitioner : Mr.S.Vijayakumar Senior Counsel for Mr.M.Kumar

ORDER

The present revision petition has been filed seeking for expeditious disposal of I.A.No.4 of 2022 in Arb.O.P.No.43 of 2021 pending on the file of Principal District Court, Tiruchirapalli.

2. According to the learned senior counsel appearing for the petitioner, the Arb.O.P.No.43 of 2021 has already been disposed of and in view of the orders passed by this Court in C.R.P(MD)No.1904 of 2021, dated 10.01.2022, they are entitled to withdraw the amount of Rs.98,99,058/- (Rupees Ninety Eight Lakh Ninety Nine Thousand and Fifty Eight only). Hence, they filed I.A.No.4 of 2022 to send for the said amount from the concerned bank. However, the said application is being 2/5

kept pending for the past one year without any progress. Hence, the present revision petition has been filed.

3. I have carefully considered the submission made by the learned senior counsel and considering the fact that the prayer is limited only for early disposal of I.A.No.4 of 2022, this Court directs the learned Principal District Judge, Trichirappalli to dispose of I.A.No.4 of 2022 in Arb.O.P.No.43 of 2021 on or before 28.02.2023 after giving due opportunity to the respondents in the said application.

4. With the above said observations, this Civil Revision Petition stands allowed. No costs.
