PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus thereby direct the 2nd respondent to issue the Machinery to participate for the work covered in Sl.No.06, 08, 11, 17, 18 and 24 of the E-tender Notice Number TN376/2025-26 dated 07.01.2026 or in the alternate direct the respondents to accept the bid to be submitted by the petitioner without machinery certificate.

ORDER

The present writ petition has been filed seeking a mandamus as against the second respondent to issue working condition of plant and machinery certificate to participate for the work covered in serial number 06, 08, 11, 17, 18 and 24 of the E-tender notice dated 07.01.2026.

2. According to the learned Counsel appearing for the writ petitioner, though he had approched the second respondent on 19.01.2026, a certificate was not issued. Hence, the present writ petition.

3. The learned Standing Counsel appearing for the second respondent submits that in case if the petitioner produces all the records pertaining to the plants and machineries as per the tender specification, a desk verification would be done.

In view of the above said facts, the petitioner is directed to place all the records relating to the plant and machineries as per the specification in the tender notification before the second respondent on 22.01.2026. After being satisfied during desk verification, the second respondent can proceed to make a physical verification of the machinery and issue a certificate, if found eligible, on or before 27.01.2026.
