O R D E R
[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the third respondent in No.611/R4 /2025 dated 12.01.2026 and direct the third respondent to grant emergency leave for a period of 15 days to the son of the petitioner namely Velmurugan, son of Karuppanan (PID No.305576) for performing marriage ceremony to the son of the petitioner at Thiruparankundram Arulmighu Murugan Temple, Madurai on 22.02.2026.
2. It is the case of the petitioner that his son was convicted in S.C. No.120 of 2021 for the offences under Section 148,148,302 of IPC and sentenced to undergo life imprisonment for the offence under Section 302 of IPC, which was also confirmed by this Court in Crl.A(MD) No.779 of 2024. While being so, the petitioner arranged marriage for the convict with one Nandhini to be solemnized on 22.02.2026. Therefore the petitioner applied for emergency leave for his son which was rejected on the ground that the son of the petitioner is facing another trial for offence under Section 302 of IPC and two other cases under NDPS Act.
3. This Court had directed the respondent police to verify whether the marriage was fixed on 22.02.2026 of not. On verification the learned Additional Public Prosecutor submitted that the marriage for the petitioner's son is fixed on 22.02.2026.
4.. Considering the fact that marriage is fixed on 22.02.2026 to the convict, this Court is inclined to grant five days emergency leave with two escorts.

Accordingly, the impugned order passed by the third respondent is set aside and writ petition is disposed of with the following directions: (i) The respondents are directed to grant five days emergency leave with two escorts to the convict prisoner namely, Velmurugan, son of Karuppanan (PID No.305576) confined at Central Prison, Salem from 20.02.2026 to 26.02.2026. The convict prisoner shall be released from the prison on 20.01.2026 at 5.00p.m., (ii) He shall report back to the Superintendent of Prison, Central Jail, Salem / third respondent, by 26.02.2026 at 10.00 a.m., (iii) The escort charges shall be borne by the petitioner and if necessary, the same shall be adjusted from the income earned by the convict prisoner during the imprisonment period.
(iv) The petitioner shall produce all necessary documents, along with a copy of this order, before the jail authorities, (v) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail
Manual. Consequently connected miscellaneous petition stands closed.
