ORDER
This Criminal Original Petition is filed to direct the respondent No. 1 to withdraw and transfer the case in Cr.No.324 of 2025 from the Respondent No.3 to Respondent No.2.
2. Learned counsel for the petitioner submitted that in a dispute between him and his brother's family, the petitioner was brutally assaulted, in which he lodged a complaint before the third respondent police and a First Information Report in Crime No.324 of 2025 came to be registered on 03.07.2025. However, there is no progress in the investigation. Hence he sought for indulgence of this Court.
3. Learned Government Advocate (Crl.side) appearing for the first respondent on instructions submitted that the case in Crime No.324 of 2025 has been registered on the complaint of the petitioner for the 2/4
offences under Section 115(2), 118(1), 126(2), 296(b) and 351(3) of BNS. After altering the offences, the charge sheet has been filed before the learned Judicial Magistrate No.2, Thanjavur and taken cognizance in C.C.No.1811 of 2025.
4. In view of the above, this Criminal Original Petition is closed, with liberty to the petitioners to challenge the final report, by filing a petition seeking further investigation under Section 173(8) Cr.P.C., / 193
(9) BNSS, 2023, if not satisfied by the manner in which final report is filed.
