ORDER

This Criminal Original Petition is filed to direct the respondent 1 and 2 to give police protection from the third respondent to the petitioner's life and limb.

Learned counsel for the petitioner submitted that the petitioner is the absolute owner of the property comprised in Natham Survey No. 243/1, New Survey No.711/2 situated in Ward No.10, new Ward No.5, Kadambur Road, within the limits of Kayathar Town Panchayat Board, measuring an extent of 1633.50 sq.ft. The third respondent herein by creating fake and forged documents trespassed into her property and claiming right over the property. Since the petitioner and her husband are facing threat at the hands of the third respondent, she has sought indulgence of this Court, by filing the present petition.

3. Learned Government Advocate (Crl.side) submitted that the third respondent is the purchaser of the land belonging to the petitioner's father-in-law. The petitioner's husband signed as a witness to the said 2/5

transaction. After knowing all the details, the petitioner suppressing the earlier sale of her father-in-law, along with her husband filed a complaint and the same was registered in CSR No.5721 of 2025. At the time of enquiry, when the petitioner was called, she did not co-operate with the enquiry. But the third respondent appeared before the respondent police and produced all the documents. After enquiry, the petitioner's complaint was closed on 02.06.2025.

4. Heard both sides and carefully perused the materials on either side.

5. It is made clear that the remedy available for the third respondent is to approach the appropriate Civil Court by filing a suit for recovery of land. Of course, the second respondent police can in no way meddle with the civil dispute between the petitioner and the third respondent. Hence, it is precisely directed that the second respondent police should not interfere with the dispute prevailing between the petitioner and the third respondent pertaining to Natham Survey No. 243/1, New Survey No.711/2 situated in Ward No.10, new Ward No.5, 3/5

Kadambur Road, within the limits of Kayathar Town Panchayat Board, measuring an extent of 1633.50 sq.ft.

6. With the above direction, this Criminal Original Petition is disposed of.
