(Crime No.109/2018) : Respondent PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C., to direct the respondent herein to file the final report in the crime No.109/2018 on the file of the first respondent herein within the time stipulated by this Court more fully within a period of ten days.

ORDER

The petitioner has filed this petition seeking a direction to the Inspector of Police to lay the final report.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

3. The learned counsel for the petitioner submitted that when the petitioner, who is arrayed as an accused in Crime No.109 of 2018 had moved Crl.O.P.(MD)No.2471 of 2019 for quashing the FIR, it was represented that final report has already been laid. Accordingly, this Court closed the said petition on 18.02.2019. However, when enquired in the concerned Court, the petitioner came to know that the final report has not yet been laid.

4. Hence, the learned Additional Public Prosecutor was required to clarify the contradictory statement that was presented before this Court and this Court also required the presence of the respondent.

5. Today, the respondent has appeared in person before this Court.

6. The learned Additional Public Prosecutor now made a statement that the statements are true in the sense when Crl.O.P. (MD)No.2471 of 2019 came before this Court on 18.02.2019 charge https://hcservices.ecourts.gov.in/hcservices/

sheet has been laid, but for correcting some defects it was not taken on file and today the final report is again laid.

7. The statement made by the learned Additional Public Prosecutor is recorded. The present petitioner is now directed to workout his remedy as per law.

8. With the above direction, this criminal original petition is disposed of.
